Terms of Service
Effective date: October 15, 2026
These Terms of Service ("Terms") are a binding agreement between you and Hi5 Biz Solutions LLC, a Texas limited liability company doing business as Hi5 Success ("Hi5," "we," "us" or "our"). They cover hi5success.com, our checkout and member portal pages, and every membership, community, course, live session, plugin, prompt, template, snapshot and other product or service we offer (together, the "Services"). By creating an account, checking a box, completing a purchase or using the Services, you agree to these Terms, our Privacy Policy, our Refund Policy and our Affiliate Disclosure. If you do not agree, do not use the Services.
Section 17 contains a binding arbitration agreement and a class action and jury trial waiver. Please read it carefully. It affects how disputes are resolved.
1. Who we are
Hi5 Success is a division of Hi5 Biz Solutions LLC, based in Fort Bend County, Texas. We provide online education and community memberships for business owners, including real estate professionals and GoHighLevel agency owners. We are an education and technology provider. We are not a real estate brokerage, law firm, accounting firm or financial advisor.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- You are buying the Services for business or professional purposes, not personal, family or household use.
- You must give us accurate, complete information and keep it current.
- Each membership is for one person. You may not share your login, give others access, or let a team use one membership. Each person who uses the Services needs their own membership.
- You are responsible for everything that happens under your account. Tell us right away at community@hi5success.com if you believe your account was used without permission.
3. What the Services include
Memberships may include, depending on the plan you buy: online lessons and replays, live group sessions and Q&A, the 90-Day Real Estate OS Live Bootcamp or other cohorts, async build reviews, community access, Claude plugins, prompt libraries, templates, a resource vault and GoHighLevel snapshots. Plan details are described on the page where you buy.
- We may add, change, update, reorganize or retire content, features, tools and bonuses at any time. We try to give notice of major changes.
- Live session dates, times, hosts and topics may change. If a live session is moved or canceled, we will reschedule it or provide a recording or substitute content. Schedule changes are not grounds for a refund.
- Live sessions may be recorded and shared with members. If you join a live session, you agree that your name, image, voice, questions and chat messages may appear in the recording.
- Any offer to build tools, plugins or resources based on member requests is at our discretion. We are not obligated to build any requested item or to deliver it by any date.
- Some bonuses are only available for a limited time or only to members who join by a stated date. Bonus terms are stated where the bonus is offered.
4. Subscriptions, billing and automatic renewal
- Memberships are subscriptions that renew automatically at the end of each billing period (monthly or yearly, based on the plan you choose) at the price shown at checkout, until you cancel.
- By purchasing, you authorize us and our payment processors to charge your payment method at the start of each billing period, without further approval from you, until you cancel.
- Price lock: if your plan says your price is locked, that price applies only while your membership stays active and in good standing. If you cancel, a payment fails and is not resolved, or your account is suspended, the price lock ends and rejoining will be at the current price.
- If a payment fails, we may retry the charge and may pause or end your access until payment is made.
- Prices do not include taxes unless stated. You are responsible for any taxes that apply.
- We may change prices for future billing periods. We will give you notice by email before a price change applies to your renewal, unless your price is locked under the terms above.
5. Cancellation
- You may cancel at any time by emailing community@hi5success.com, or through your account if that option is available. Cancel before your next renewal date to avoid the next charge.
- Cancellation stops future charges. Your access continues until the end of the billing period you already paid for, then ends.
- Canceling does not entitle you to a refund for the current period or any unused time. See our Refund Policy.
6. Refunds and chargebacks
- All purchases are final and non-refundable, as described in our Refund Policy.
- If you have a billing problem, contact us first at community@hi5success.com. We will fix genuine billing errors, such as a duplicate charge.
- If you file a chargeback or payment dispute without first contacting us, or after receiving access to the Services, we may suspend or end your access immediately, contest the dispute with records of your purchase, account activity and agreement to these Terms, and recover any fees the dispute costs us, to the extent the law allows.
7. License to use the Services
Subject to these Terms and full payment, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for your own business while your membership is active. You may not:
- Share, resell, sublicense, publish, redistribute or give away any part of the Services, including lessons, recordings, plugins, prompts, templates, snapshots or downloads.
- Record, screen-capture, download or copy live sessions or lessons, except where we provide a download for your own use.
- Use the Services, or any content from them, to create, train or market a competing course, community, plugin, prompt library, template or product.
- Use bots, scrapers or other automated tools to access or copy the Services.
- Remove copyright or other notices.
Plugins, prompts and templates you download may be used in your own business, including for your own clients' marketing, but may not be resold or shared as standalone products. Snapshots are also subject to the license terms stated when they are delivered. If your membership ends, your license to access member-only content ends with it.
8. Intellectual property
The Services and all content in them, including lessons, recordings, plugins, prompts, templates, snapshots, workflows, text, graphics, logos and the Hi5 and Hi5 Success names, belong to Hi5 or our licensors and are protected by copyright, trademark and other laws. Except for the license in Section 7, no rights are granted to you. Your own business content that you create with our tools belongs to you.
9. Community rules
To keep the community useful and safe, you agree not to:
- Harass, threaten, demean or discriminate against anyone.
- Post spam, unsolicited offers or recruiting pitches, or solicit members for your own products or services without our permission.
- Post content that is unlawful, misleading, infringing, or that violates anyone's privacy.
- Share other members' personal information, posts, or anything said in the community outside the community.
- Post anything that violates Fair Housing or other applicable laws.
We may remove content and suspend or end access for anyone who breaks these rules, without a refund.
10. Your content and feedback
You keep ownership of the content you post (posts, comments, questions and uploads). You give us a worldwide, royalty-free license to host, display, copy and use that content to operate and improve the Services, including in live sessions and recordings. If you send us ideas or feedback, we may use them without any obligation to you.
11. AI tools and your responsibilities
- The Services teach and use artificial intelligence tools, including Claude by Anthropic. AI output can be inaccurate, incomplete, outdated or inappropriate. You are responsible for reviewing and approving everything AI produces before you use, publish or send it.
- You are solely responsible for how you run your business and for following every law, rule and platform policy that applies to you, including Fair Housing laws, the TCPA, CAN-SPAM, A2P 10DLC and carrier messaging rules, data privacy laws, advertising rules, MLS and IDX rules, licensing laws, and your brokerage's policies.
- Nothing in the Services is legal, tax, financial, real estate or other professional advice. Consult your own qualified professionals before acting.
12. Third-party services
The Services use and teach third-party tools, including GoHighLevel, Anthropic (Claude), payment processors and others. Hi5 Success is not affiliated with, endorsed by or responsible for any of them. Third-party tools are governed by their own terms and pricing, may change or stop working at any time, and may require separate paid subscriptions you buy directly from them. GoHighLevel is optional and not required to join or use your membership. We are not responsible for third-party outages, feature changes, price changes, data loss or account actions.
13. No guarantee of results
We do not promise or guarantee any income, earnings, sales, leads, listings, closings, appointments, savings, rankings, views, followers or other results. Any results, examples, timelines or testimonials we share are not typical, are not a promise, and depend on many factors outside our control, including your effort, skill, experience, market, budget and business. Statements such as "put your first AI employee to work in 30 days" describe what the program is designed to help you build, not a guaranteed outcome. You accept all risk for business decisions you make.
14. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. If we fix bugs or answer questions, we do so as a courtesy, not as a warranty.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW:
- HI5, ITS OWNERS, EMPLOYEES, CONTRACTORS AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, BUSINESS, DATA, GOODWILL OR OPPORTUNITIES, EVEN IF ADVISED THEY WERE POSSIBLE.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
- THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE AND STATUTE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
16. Indemnification
You agree to defend, indemnify and hold harmless Hi5 and its owners, employees, contractors and partners from any claims, losses, damages, fines, penalties, costs and expenses (including reasonable attorneys' fees) arising from your use of the Services, your business, your content, your messaging and marketing, your violation of these Terms, or your violation of any law or anyone else's rights.
17. Dispute resolution, binding arbitration and class action waiver
- Talk to us first. Before filing any claim, you agree to email a written description of the dispute and the relief you want to info@h5biz.com. We will try to resolve it informally within 30 days. Neither side may start arbitration until that 30-day period ends.
- Binding arbitration. Any dispute, claim or controversy arising from or relating to these Terms or the Services, including whether a dispute must be arbitrated, will be resolved by final and binding individual arbitration, not in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this section. Arbitration will take place in Fort Bend County, Texas, unless both sides agree to a different location or to hold it by video or on written submissions. Judgment on the award may be entered in any court with jurisdiction.
- Small claims. Either side may instead bring an individual claim in a small claims court in Fort Bend County, Texas, if the claim qualifies.
- Class action and jury trial waiver. You and Hi5 each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative action or arbitration. YOU AND HI5 EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. The arbitrator may not consolidate claims or award relief to anyone other than the individual party.
- Exceptions. Either side may ask a court for an injunction to stop infringement or misuse of intellectual property or unauthorized access to the Services.
- Time limit. Any claim must be filed within one year after it arises, or it is permanently barred, to the extent the law allows.
- Severability. If the class action waiver is found unenforceable for a claim, that claim must proceed in court in Fort Bend County, Texas, and not in arbitration. The rest of this section stays in effect.
18. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and by the Federal Arbitration Act. For any matter not subject to arbitration, you and Hi5 agree to the exclusive jurisdiction of the state and federal courts located in Fort Bend County, Texas.
19. Suspension and termination
We may suspend or end your access at any time if you break these Terms, misuse the Services, fail to pay, file a chargeback, or create risk or legal exposure for us or other members. Termination for these reasons is without a refund. Sections that by their nature should survive (including payment, licenses ending, intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution) survive termination.
20. Communications
By creating an account or purchasing, you agree that we may contact you by email, and by text message if you give your mobile number and consent, about your account, purchases, sessions and support. Marketing messages are only sent with your consent and you can opt out at any time. Our Privacy Policy explains how text messaging works, including how to reply STOP to opt out.
21. Changes to these Terms
We may update these Terms. We will post the new version with a new effective date and, for material changes, notify active members by email. Changes apply going forward. Continuing to use the Services after a change takes effect means you accept it. Changes to Section 17 will not apply to disputes we already know about before the change.
22. General
- These Terms, together with the policies they reference and any terms shown at checkout, are the entire agreement between you and Hi5 about the Services.
- If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest will stay in effect.
- Our failure to enforce a provision is not a waiver.
- You may not transfer your rights under these Terms. We may assign them as part of a merger, sale or reorganization.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- Headings are for convenience only.
